New Texas Auction Law In Effect!!
On June 14, 2013, Texas Governor Rick Perry signed into law HB 3038 which regulates Auctions in Texas regardless of the method of bid collection that is used. This further clarifies the law that makes it illegal to offer auction services, negotiate a contract or execute an auction contract without a license. The law goes into effect July 5, 2013.
This includes AUCTIONS IN THE STATE OF TEXAS, LIVE OR ONLINE.
So what does this meant to you as a non-profit?
Bottom line is, you MUST hire a licensed auctioneer to perform your auction regardless if you are a non-profit or not. In the past, the local pastor, local judge or good - O - boy could perform as an auctionner, not anymore.
Please do not put your group in jeopardy and take a chance on possible fines.
Hire a licensed auctioneer, ask to see his or her license,
if they cannot produce one, do not hire them.
